Biddo — Host Terms & Conditions
By submitting an Auction Host application on Biddo.co.za (“Biddo”, “we”, “us”), you (“the Host”, “you”) agree to the following:
1. Platform role
Biddo provides an online auction software platform only. Biddo is not the auctioneer of record for your sale unless separately agreed in writing. You remain responsible for your auction content, lot descriptions, reserves, bidder approval, sale outcomes, invoicing to buyers (where applicable), collection/delivery, and compliance with applicable law.
2. Application and pricing
Submitting this application does not create a paid hosting contract. After we review your application, Biddo will contact you with commercial terms. Fees may be a fixed fee, a percentage of hammer/sale value, or a combination, and may vary by auction size, lot count, expected bidders, and services required. No fees are final until confirmed by Biddo in writing.
3. No guarantee of results
Biddo does not guarantee bidder numbers, bid amounts, reserve achievement, sale completion, payment by buyers, or any commercial outcome of your auction.
4. No liability for losses
To the maximum extent permitted by law, Biddo is not liable for any direct, indirect, incidental, special, consequential, or punitive loss or damage arising from use of the platform, including but not limited to lost profits, lost sales, business interruption, reputational harm, data loss, or failed transactions.
5. Technical issues
The platform may be unavailable, delayed, or interrupted due to maintenance, connectivity, device/browser issues, third-party services, power or network failures, or force majeure. Biddo does not accept responsibility for any loss caused by technical problems, downtime, delayed bids, missed notifications, or incorrect display of information, except where liability cannot be excluded by law.
6. Host responsibilities
You warrant that you have authority to sell the lots listed; that descriptions and images are accurate and lawful; that you will not misuse bidder data; and that you will not use the platform for fraudulent, illegal, or misleading activity. You are responsible for your staff accounts and access credentials.
7. Content and moderation
Biddo may refuse, suspend, or remove auctions, lots, or Host accounts that breach these terms, create legal risk, or harm the platform or its users.
8. Buyer and bidder relationships
Contracts of sale are between the Host (or the seller you represent) and the successful bidder, subject to your auction rules. Biddo is not a party to those contracts and is not responsible for payment disputes, collection, delivery, defects, or refunds unless separately agreed.
9. Indemnity
You indemnify and hold harmless Biddo, its owners, employees, and contractors against claims, losses, damages, and costs arising from your auctions, lots, conduct, content, or breach of these terms.
10. Changes
Biddo may update these terms. Continued use of the Host features after notice of changes constitutes acceptance of the updated terms.
11. Governing approach
These terms are intended to protect Biddo as a technology provider. If any clause is unenforceable, the remaining clauses continue in force.
If you do not agree, do not submit a Host application.
